Motobyo Marketplace Rules and Policies

Motobyo is committed to providing a secure and fair marketplace for our buyers and sellers. To support this commitment, we’ve put in place rules and policies that govern our expectations of buyers, sellers, bidders and visitors and the actions we’ll take to keep you safe.

By becoming familiar with and following our policies, you can help us maintain a safe environment for all, and be able to avoid interruptions that might come from inadvertent violations of our rules.

Some of the rules reflect legal requirements, while others are based on our experience of how best to protect everyone using Motobyo services.

In our How it Works section, you can find information regarding buying and selling on the platform and details on how we protect your personal data.

You can also find our User Agreement, User Privacy Notice. These lay out the most critical information around our terms of use, the information we collect from you, how we use that info and how we keep that information safe.

Member behavior policies

When you buy and sell or interact with other members on Motobyo, we expect that you and your information are treated in a respectful manner, and that you afford other members the same courtesy.

Threats, offensive language and hate speech are not allowed.

To ensure that all users have a positive experience on Motobyo, we don’t allow members to use threats, or language that we consider to be abusive or offensive.

What is the policy?

It is strictly prohibited to engage in threats of bodily or physical harm or any kind of harassment using any method including by email, member to member messaging, on our public message boards (such as our discussion boards, groups, and other community areas).

If a member receives a threat, it should be reported to local law enforcement.

Hateful, obscene, offensive, profane, racist, sexual, defamatory, or violent language cannot be used in profiles, user IDs, chat rooms, discussion boards, member communications, listings, product pages, and any other areas of the site.

Activity that does not follow the Motobyo policy could result in a range of actions including for example: administratively ending or canceling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

To keep the marketplace functioning effectively, we know it is important for members to be able to communicate easily with each other.

However, to keep everyone in our community safe we have guidelines and policies that cover how you communicate.

We don’t allow our members to:

  • Send spam
  • Upload inappropriate or explicit photos
  • Upload photos not related to the item for sale
  • Threaten others, or use profanity or hate speech
  • Send viruses, malicious code, or software through our messaging service

Rules and policies for bidder and buyers

When you bid on or buy and item on Motobyo, you’re agreeing to the rules we’ve set out for our community and any specific terms laid out by the seller of the item. If you have questions or need clarification of any seller imposed terms, please contact the seller prior to placing any bids on the item. If someone makes a bid on an auction listing, and then retracts that bid, they could gain an unfair advantage – maybe by discovering a reserve price, or where another bidder’s maximum bid stands.

We want to ensure a fair marketplace for all our users, so we only allow bids to be retracted under certain circumstances:

When can I retract a bid?

A bid is a binding contract that’s active until an auction-style listing ends or you’re outbid. You can only retract a bid if the seller significantly changed the description of the item, if you accidentally bid the wrong amount, or if you can’t reach the seller. Retracting a bid for any other reason is considered an invalid bid retraction. If you’re retracting a bid for a valid reason, you’ll also need to make sure you do so within the bid retraction timeframe.

What should I do if I think someone's manipulating the bidding process?

If you think another member is violating our bid retraction guidelines, you should contact us to let us know.

Shill bidding is prohibited. Shill bidding happens when someone bids on an item to artificially increase its price, desirability, or search standing. Shill bidding can happen regardless of whether the bidder knows the seller. However, when someone bidding on an item knows the seller, they might have information about the seller’s item that other shoppers aren’t aware of. This could create an unfair advantage, or cause another bidder to pay more than they should. We want to maintain a fair marketplace for all our users, and as such, shill bidding is prohibited.

Best practices for communication

Motobyo allows any registered members to contact item sellers directly using the messages feature in your dashboard. We recommend this form of communication.

Motobyo requires both buyers and sellers to make immediate contact after an auction has ended with a winning bidder or with a private offer being accepted. Payment arrangements must be made immediately and all final payments are due within 72 hours of auction close. Bidders: Be prepared to pay in full for all items before you place a bid. A Motobyo seller can report an unpaid item if no contact has been made with the buyer within 48 hours. Non-paying bidders will have their accounts suspended.

Private offer to buy now

Communicating with any seller and making an offer should be done through the messages feature in your dashboard. After discussing the item, pricing and terms it’s best for the seller to send a private offer to the potential buyer so the transaction is completed on the Motobyo platform. Once the offer has been accepted by the buyer, the auction is ended in their favor and the check-out process can be completed in your dashboard. Please note: if you complete a transaction in-person or offline and not on the Motobyo platform, the buyer will have no access to extended coverages or other Motobyo offerings.

Purchase Best Practices

Purchases should be completed on the Motobyo platform in order to keep record of the transaction and allow the buyer access to online tools and offerings on the Motobyo site.

All communications should take place using the message feature in your dashboard. This helps by keeping a record of conversations, offers and sale particulars.

Prohibited and restricted items

Motobyo does not allow the listing of any vehicle which has been mis-described or improperly categorized. Listings violating these terms will be removed and listing fees will not be returned. Motobyo does not allow the listing of salvage, junk, or non-running vehicles unless this information has been properly described in the most straightforward manner and deemed acceptable by a Motobyo site moderator. Listings that violate any Motobyo policy will be removed and listing fees will not be returned. Please contact customer care to learn how to list classic vehicles or others that do not qualify for an instant cash offer.

Selling policies

Our selling policies are designed to help you deliver the best experience possible to your bidders and buyers.

Always take your own images and write your own descriptions for the items you list. Never use stock photos or photos of another item. Using photos of another item is a violation of policy.

Frequently Asked Questions

What should I do if my images or text is being used by another member?

You may contact the other member and ask them to remove your image or text from their listing. You can also contact customer care here at Motobyo and we can help.

Can I use images that I copied from other websites in my listing or product page?

No, you can’t use images copied from other websites or internet searches in your listing. Original images of your item are required.

Manipulating search and browse experience by adding popular keywords in your listings that don’t have any relation to your items, or using other tactics that could mislead buyers, is not allowed.

To make sure our search results give buyers the best experience possible, it’s also important to accurately describe your items and use a clear title to help bidders and buyers find your item.

What is the policy?

  • Manipulating search results to gain unfair visibility of a listing is not allowed
  • Using keywords that are not directly related to the item for sale is not allowed. All the words in the listing need to be accurate and refer only to the item for sale
  • Listings that make comparisons with other products are not allowed
  • Listings that promote other listings are not allowed
  • Listings can’t include keywords with question marks, as this can be misleading for buyers. If any item details are unclear or unknown, they should be left out of the listing
  • Offering different products in a single listing is not allowed. This includes:
  • Selling different brands or models in the same listing

Frequently Asked Questions

Can I send a private offer to sell an item to people I know?

Yes, you can send a private offer to anyone who has communicated with you through your messages feature in your dashboard.

Can my friends or employees bid on my listings?

No, your friends and employees cannot bid on your items, and you’re not allowed to bid on theirs. Sellers with employees should make sure their workers are also aware of this policy. Using the private offer feature is allowed though, so you can still sell to friends, relatives and employees on the Motobyo platform.

How do I report shill bidding?

If you think that another member is shill bidding, please report this behavior to customer care at Motobyo.

Activity that doesn’t follow policy could result in a range of actions including administratively ending or cancelling listings, hiding or demoting all listings from search results, buying or selling restrictions, account suspension, etc. All fees paid or payable in relation to listings in which we take any action can’t be refunded or otherwise credited.
